Agreement to these terms

These terms apply when you use our website, create an account, purchase products or receive a practitioner recommendation dispensed by NutraAura Pharmacy. By using our website or placing an order, you agree to these terms. If you do not agree, please do not use the website.

Who we are

NutraAura Pharmacy is an Australian online pharmacy offering practitioner-grade wellness products, with oversight from AHPRA-registered pharmacists, and a dispensing service for qualified practitioners and the patients they recommend to us. Our business details are available on request using the contact details at the end of these terms.

Our products

The products we sell are therapeutic goods regulated by the Therapeutic Goods Administration (TGA). Always read the label and follow the directions for use. If symptoms persist, worsen or change unexpectedly, talk to your health professional.

Some products are supplied only on a qualified practitioner's recommendation, or after a suitability check by our pharmacy team. We may decline to supply a product where our pharmacist considers it is not clinically appropriate for you. If we decline supply after you have paid, we will refund you.

Pricing and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Payments are processed securely by Stripe, and we accept card payments as well as Apple Pay, Google Pay, Link and PayPal. We may change our prices at any time, but changes will not affect orders we have already accepted.

Where a qualified practitioner has recommended products for you, how they are paid is disclosed here in full: Your practitioner is paid out of our dispensing margin, not on top of your order — their fee never increases the price you pay. You pay our normal retail price — the same price as anyone shopping with us directly, with nothing added for the recommendation.

Orders and acceptance

When you place an order, you make an offer to purchase. We accept your order when we confirm it and take payment. We may cancel an order and refund you in full where we cannot supply — for example where a product is out of stock, a pricing error has occurred, or supply would not be clinically appropriate.

Delivery

We deliver within Australia only. Delivery timeframes shown at checkout are estimates and may be affected by carrier delays. Please ensure your delivery details are accurate — we are not responsible for delays caused by incorrect address information.

Returns and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL. Because our products are therapeutic goods, we may not be able to accept change-of-mind returns of opened products for safety reasons — contact us before returning any item and we will explain your options.

Your account

You are responsible for keeping your account credentials confidential and for activity that occurs under your account. Please provide accurate information when you register and keep it up to date. Let us know immediately if you suspect unauthorised use of your account. We may suspend or close accounts used in breach of these terms.

Communications and marketing

When you create an account or place an order we will email you about that account and those orders — confirmations, dispatch and tracking, verification and security notices. These are service messages and you cannot opt out of them while you hold an account.

If you leave items in your cart or start a checkout and do not finish it, we may email you a reminder, which may include a postage offer, because you hold an account with us. We rely on that relationship, and on the notice shown when you sign up, in accordance with the Spam Act 2003 (Cth). You can turn these reminders off at any time in your account settings or with the link in any reminder email, and we will stop within the time the law allows.

Unless you tell us not to, we may also send you marketing by email: offers and new products. We rely on your relationship with us as a customer and on the notice shown when you sign up, in accordance with the Spam Act 2003 (Cth). You can opt out at any time by unticking the box when you sign up, by using the unsubscribe link in any marketing email, or in your account settings, and we will stop within the time the law allows. Opting out does not affect service messages or your ability to shop with us. The unsubscribe link in any of our emails stops both marketing and reminders; you can switch either back on in your account settings.

We never sell your details, and we do not send marketing by SMS or post unless you ask us to.

Practitioner recommendations and dispensing

Where a qualified practitioner recommends products for you, that recommendation is theirs, not ours. We dispense what they have recommended, and a registered pharmacist reviews every practitioner-only item before it is supplied. Neither the recommendation nor that review is a substitute for medical care, diagnosis or treatment by a doctor. Always seek advice from a qualified medical practitioner for medical conditions, and never delay seeking medical advice because of something you have been told here. In an emergency, call 000.

Intellectual property

The content on our website — including text, images, logos and branding — is owned by or licensed to us. You may view and use it for your personal, non-commercial use, but you may not otherwise copy, reproduce or distribute it without our written permission.

Limitation of liability

To the extent permitted by law, and without limiting your rights under the Australian Consumer Law, we exclude liability for indirect or consequential loss arising from your use of the website or our products, and our total liability in connection with an order is limited to resupplying the products or refunding the amount you paid for them.

Changes to these terms

We may update these terms from time to time. The current version will always be published on this page with its last-updated date. Changes apply from the time they are published and do not affect orders we have already accepted.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
